Prohibition notices and prohibited people applying for a screening check

    A prohibition notice will be issued by the Screening Unit where it determines the person poses an unacceptable risk to children and is prohibited from working with children.

    Notices are put on an applicant's personal screening account or sent via registered post.

    Employers and organisations who have a registered interest in the Working with Children Check will be notified of the prohibited status only. No information related to why a prohibition notice was issued is shared.

    Right of review

    If you have been issued with a prohibition notice you may be able to apply directly to the South Australian Civil and Administrative Tribunal (SACAT) to review the decision of the Screening Unit (conditions apply).

    The application to SACAT should be made within 14 days after you get the prohibition notice. SACAT may allow an extension of time in some circumstances.

    Apply for a SACAT review

    SACAT refer to the Screening Unit as the Central Assessment Unit (CAU). CAU is the title, provided within legislation, under which an administrative unit of government is established to perform screening checks.

    Revocation

    You can apply to the Screening Unit to have a prohibition notice revoked (removed) if:

    • the prohibition notice was issued in error, such as mistaken identity
    • there is fresh and compelling assessable information that, if assessed in the course of the original WWCC, would have affected the determination to prohibit you.

    You’ll need to provide evidence to support your application. This may include court documents or transcripts, police reports, professional reports or assessments, or statutory declarations.

    The Screening Unit may refuse to consider an application to revoke a prohibition notice if an application to revoke the same notice has been considered in the last 5 years.

    Fee

    The fee to apply for a revocation is $140. This is non-refundable.

    If you remain prohibited or the Screening Unit refuses to consider your application because you have applied for revocation in the last 5 years, you will not receive a refund.

    Prohibited person

    You can not apply to have your prohibition revoked if you:

    • have been found guilty of a prescribed offence committed as an adult – unless the conviction is now spent
    • are prohibited from working with children under the law of the Commonwealth, or of another state or territory.

    If you are currently prohibited from working with children in South Australia or another state or territory, you cannot work or volunteer with children.

    If you have ever been prohibited from working with children in South Australia or another state or territory, you must reapply and get a Working with Children Check to work or volunteer with children.
