Excluded persons for NDIS Worker Checks

An exclusion will be issued by the Screening Unit where it determines the person poses a risk of harm to people with disability.

Notices are put on an applicant's personal screening account or sent via registered post.

The Screening Unit will also notify the NDIS Quality and Safeguards Commission, who will then notify all NDIS providers who are linked to you.

Right of review

If you have been issued with an exclusion you may be able to apply to the South Australian Civil and Administrative Tribunal (SACAT) to review the decision (conditions apply).

The application to SACAT should be made within 14 days after you get the exclusion notice. SACAT may allow an extension of time in some circumstances.

Apply for a SACAT review

SACAT refer to the Screening Unit as the Central Assessment Unit (CAU). CAU is the title, provided within legislation, under which an administrative unit of government is established to perform screening checks.

Early application

An excluded person is banned from applying for an NDIS Worker Check for 5 years from the date of exclusion.

You can lodge a request with the Screening Unit to make an early application for an NDIS Worker Check if you have had a relevant change in circumstances. This includes:

  • proceedings for an offence on which the exclusion or cancellation was based are withdrawn or dealt with without a finding of guilt
  • a finding of guilt for an offence on which the exclusion or cancellation was based is quashed or set aside
  • a finding in respect of a risk assessment on which the exclusion or cancellation was based is quashed or set aside, or otherwise ceases to have effect
  • any other change of circumstances the Screening Unit considers should result in the person being permitted to make an application.

You’ll need to provide evidence to support your request. This may include court documents or transcripts, police reports, professional reports or assessments, or statutory declarations.

Excluded person

You cannot reapply for an NDIS Worker Check if you:

  • have been found guilty of a disqualification offence committed as an adult
  • are excluded from working with people with disability under the law of the Australian Government, or of another state or territory.

If you are currently excluded from working with people with disability in South Australia or another state or territory, you cannot work or volunteer with people with disability.
