Retirement village residence rules

The residence rules set out expectations relating to the use of the retirement village to ensure enjoyment of the village by all residents.

Residents must receive a copy of the village residence rules before signing their residence contract (see documents the operator must provide).

What residence rules must cover

Residence rules must address (but are not limited to):

  • visitors to retirement village including short-term or long- term visitors
  • noise
  • parking
  • collection and disposal of rubbish
  • pets
  • gardens and landscaping
  • the use and operation of services and facilities in the village (including restrictions on the use and operation of services).

Proposing changes to residence rules

A change to the residence rules can be proposed by:

  • the operator
  • the residents’ committee
  • at least 20% of residents.

Consultation requirements

When a change is proposed, the operator must consult with residents before making a decision.

At a minimum, the operator must:

  • provide clear and accessible information in plain English
  • allow time for residents to ask questions and provide feedback
  • consider all feedback before deciding
  • share the outcome of the consultation and explain the reasons for the decision.

Providing updated rules

If a change is made, the operator must issue an updated set of residence rules to every resident.

If a rule is deemed unfair

A resident may apply to SACAT if a residence rule, or part of a rule, is harsh, oppressive, unconscionable or unjust.

SACAT can decide to:

  • declare the rule void, or
  • amend the rule.
