Remarketing your retirement village residence

    When leaving your retirement village, the residence will usually need to be remarketed before it can be relicensed.

    Each operator must have a written remarketing policy that explains your rights and responsibilities, and the operator’s obligations.

    Your contract must be terminated before your residence can be relicensed. You can find more information about ending a residence contract.

    Remarketing fees and charges

    The operator can only charge remarketing fees if:

    • the fee is stated in your residence contract, or
    • the fee can be calculated using a method set out in the contract.

    If your contract was entered into before 2 February 2026 and does not specify remarketing costs, the operator cannot charge more than the reasonable costs of remarketing your residence.

    If the village uses a general marketing strategy, part of these reasonable costs may include a fair share of that broader marketing activity.

    When remarketing can begin

    Once you have:

    • decided to end your residence contract, and
    • given written notice to the operator,

    the operator can start taking preliminary steps to remarket your residence.

    The villages remarketing policy should clearly outline the processes involved in remarketing, including:

    Meeting with you

    • the operator may meet with you or your representative to explain the remarketing process.

    Refurbishment requirements

    • whether your residence needs refurbishment
    • who is responsible for organising work and covering costs
    • when any work will be carried out.

    Setting the initial price

    • how the initial remarketing price is decided
    • when and how the price may be reviewed or changed
    • your right to request an independent valuation and how this will be funded.

    Advertising

    • the type and frequency of advertising the operator will undertake
    • how the operator will ensure your residence is marketed at least as actively as new residences available at the same time.

    Associated costs

    • who pays for valuations, advertising and any other remarketing-related costs
    • how these costs are calculated or determined.

    Your responsibilities

    • what you may need to do as part of the remarketing process
    • steps required from both you and the operator when the residence is relicensed.

    Settlement

    • the settlement process
    • fees and charges that will be deducted at settlement
    • the settlement statement you will receive
    • costs related to relicensing that the operator may deduct.

    Monthly progress reports

    The operator must give you a written progress report at least once a month.
    These reports must include:

    • advertising undertaken for your residence and the village
    • the number of enquiries received
    • the number of people who have viewed the residence
    • the number of other residences being remarketed
    • the number of residences sold or relicensed in the previous month.

    In some cases, a village remarketing policy might not contain all of this information because it does not apply to the village, or some residences in the village. This includes where:

    • no exit entitlement is payable to residents
    • the payment of an exit entitlement is not contingent on the sale of the right to reside in the residence
    • the sale of the right to reside in the residence does not require going to market.
