Obligations and compliance for NDIS service providers

Certain NDIS service providers are required by law to comply with the new South Australian laws.

Is this relevant to your service

You need to use the Restrictive Practices Authorisation scheme if you work in an organisation that:

  • is registered with the NDIS
  • provides NDIS supports and services, that may include a regulated restrictive practice
  • provides supports and services to NDIS participants.

Complying with the scheme

NDIS service providers must get authorisation for the use of regulated restrictive practices through the Restrictive Practices Authorisation scheme.

  1. Step 1

    Register

    Register your organisation with the Restrictive Practices Authorisation scheme through the restrictive practices system.

  2. Step 2

    Nominate

    NDIS service providers appoint an authorised program officer (APO) to assess, endorse and authorise the use of regulated restrictive practices with their NDIS participants.

    The appointed person must be approved by the Restrictive Practices Unit.

    To get the unit's approval you must nominate your proposed authorised program officer using the restrictive practices system and wait for confirmation of their approval.

  3. Step 3

    Apply

    Apply for authorisation of restrictive practices through the restrictive practices system and provide information about why the restrictive practice is needed.

  4. Step 4

    Review applications

    The APO or senior authorising officer reviews applications and makes decisions about restrictive practices.

    Decisions are recorded in the restrictive practices system.

  5. Step 5

    Reporting

    NDIS service providers must comply with reporting obligations.
