Extensions or exemptions for incorporated associations

In some cases, an incorporated association can apply for an extension or an exemption from certain requirements of the Associations Incorporation Act 1985.

This is in circumstances where it would be unreasonable or unfair, unwarranted or inappropriate to comply with the Act.

Apply for an extension or exemption

CBS can:

  • extend any time limit set by the law (even if the amount of time has already passed).
  • exempt an association or an officer of that association from their obligation to comply with any part of the law.

There is a fee of $81.00.

What you'll need

To apply for an extension or exemption, you must outline the exceptional circumstances that apply. This includes:

  • the relevant part of the Associations Incorporation Act 1985 you want an extension for or exemption from
  • the reasons why, including any unique or special circumstances that apply
  • how full compliance with the Act would be unreasonable for your association
  • what alternative measures are proposed
  • any public interest considerations.

Once your application has been granted, CBS can revoke or vary the conditions of approval at any time. The association will be notified about this in writing.
