South Australia Police (SAPOL) can issue an immediate loss of licence for particular offences.
If police issue you an immediate loss of licence, you will also be issued an expiation notice or a summons for court.
You will receive written confirmation of the immediate loss of licence from Service SA.
You may receive a further disqualification notice for the offence if you are required to serve a longer disqualification period than the period of the immediate loss of licence.
Immediate loss of licence offences
Speeding offences
- Excessive speed: exceeding the speed limit by 45 km/h or more — immediate loss of licence for 6 months
- you will also gain 9 demerit points and receive an expiation fee.
- Truck or bus driver exceeding the speed limit by more than 10 km/h on the South Eastern Freeway descent
- Truck or bus driver failing to use low gear on the Southern Eastern Freeway descent.
Blood alcohol or drug offences
- BAC 0.08 - 0.149 — immediate loss of licence for 6 months
- BAC 0.15 or more — immediate loss of licence for 12 months
- Driving with prescribed drug — immediate loss of licence for 3 months
- Driving or attempting to put a vehicle in motion while under the influence — immediate loss of licence for 12 months
- Refuse to submit to an alcohol test or breath analysis — immediate loss of licence for 6 months
- Refuse to submit to a drug screening test, oral fluid test or blood test — immediate loss of licence for 6 months
- Refuse to provide a blood sample by a driver of a vehicle, or a driver who is involved in an accident that results in people being admitted to hospital through injury — immediate loss of licence for 6 months.
For second or subsequent offences with BAC between 0.05 and 0.079, you will be issued a drink driving disqualification.
Other offences
The below offences will result in an immediate loss of licence for 12 months.
- Cause death by vehicle
- Reckless and dangerous driving
- Causing harm by dangerous use of a motor vehicle
- Causing serious harm by dangerous use of a motor vehicle
- Causing death by careless use of a motor vehicle
- Causing serious harm by careless use of a motor vehicle
- Leaving scene of accident after causing harm by careless use of a motor vehicle
- Leaving scene of accident after causing death by careless use of a motor vehicle
- Leaving scene of accident after causing serious harm by careless use of a motor vehicle.
