Apply for approval of a responsible person

Licensed venues must be personally supervised and managed by an approved responsible person (RP) at all times when open to the public. If your venue is not open to the public, an RP is not required.

Approval as a responsible person only authorises the person to supervise and manage the liquor operations of the business. It does not authorise the person to supervise and manage any gaming operations of the business.

The Liquor and Gambling Commissioner must be satisfied that you are a fit and proper person. The honesty, integrity and reputation of both you and your associates will be taken into account in deciding whether you are fit and proper.

An individual can apply to be approved as a responsible person, or a licensee can lodge an application on an employee's behalf.

  • the names, addresses and date of birth of relatives and close associates
  • information on any offences you have been convicted of - failure to disclose convictions, including traffic infringements, may delay your application and SA Police could prosecute you for failing to declare

Responsibilities of RPs

A responsible person has a number of responsibilities and obligations under the Liquor Licensing Act 1997 and the Commissioner’s Codes of Practice including:

  • recognising the signs of intoxication
  • not serving anyone who shows signs of intoxication
  • discouraging patrons from actions that can cause harm
  • knowing when to stop serving someone who is intoxicated
  • knowing when it is appropriate to remove a patron from a venue
  • checking identification documents to ensure that a minor is not consuming alcohol at the venue
  • recognising when it is appropriate to bar someone from a venue.

Training

A responsible person is required to complete nationally accredited responsible service of alcohol training (RSA) within three months of being approved.

Previously approved as responsible person

If you believe you have been previously approved as a responsible person and have an ID number, you can check whether you are currently approved.

ID badges and replacements

An approved responsible person is issued with a photo identification badge indicating that they are approved as a responsible person under the Liquor Licensing Act 1997.

This badge must be worn at all times when acting in the role.

If you are approved as a gaming manager or gaming employee you may not need to pay the badge fee, but instead print a badge for both gaming and liquor from the Barring and online employee notification system (BOEN).

What happens next

Assessment and interim approval

Your application will be assessed to determine whether an interim approval can be granted. The assessment will take into consideration your criminal history and creditworthiness.

An interim approval will allow you to commence working at a licensed venue without needing to wait for permanent approval to be granted.

Not all applicants are eligible for interim approval as this approval is still subject to an assessment.

Interim approval granted

If you are granted interim approval you will receive notification together with the ID badge in the mail, approximately 3 weeks after lodging your application.

An interim approval can be granted for up to six months. The date your interim approval will be made ongoing will be stated in your notification.

CBS will provide police with a copy of your application. If there is no information of concern returned from police, your approval will become ongoing on the date in your notification.

If the police provide CBS with any information of concern, you will be contacted and may be asked to do one of both of these:

  • provide written submissions addressing why your approval should be made ongoing
  • attend a scheduled hearing.

A decision will then be made on your application.

Interim approval not granted

If interim approval is not granted you will need to wait until the assessment of your application is fully complete. This can take six to to eight weeks.

CBS will provide police with a copy of your application. If there is no information of concern returned from police and the Liquor and Gambling Commissioner is satisfied that you are a fit and proper person your application will be granted ongoing and your ID badge will be mailed to you.

If the Commissioner has concerns or the police provide CBS with any information of concern, you will be contacted and may be asked to do one or both of these:

  • provide written submissions addressing why your approval should be made ongoing
  • attend a scheduled hearing.

A decision will then be made on your application.
