Working for a labour hire provider

    South Australia’s labour hire licensing scheme aims to uphold workers’ rights and avoid exploitation.

    Your rights

    Your rights are protected by State and Commonwealth laws.

    You are entitled to:

    • be paid at least the minimum wage
    • a safe workplace
    • reasonable hours, rest breaks and time off work
    • information on the terms and conditions of your employment
    • be treated fairly and with respect, free from discrimination
    • suitable accommodation if it’s provided to you
    • safe transport if it’s provided to you
    • be a member of a union if you want to.

    If you’re working for a labour hire provider who is not providing this, you can report it to the relevant authority relating to your concern below.

    Minimum wage, deductions from wages and rest breaks

    Minimum pay rates apply.

    Employers usually can’t deduct money from your pay without you agreeing.

    The Fair Work Ombudsman (FWO) provides information about employer responsibilities, rest breaks, paying workers, minimum wages, pay slip and record-keeping requirements and when employers can make deductions. It’s pay calculator can also work out pay rates, penalties and allowances.

    Safe workplaces

    Your employer has a legal responsibility for your health and safety at work.

    You should receive health and safety information, training and protective equipment (if required), free of charge.

    Check if a labour hire provider is licensed

    Make sure the provider you’re working for is licensed. You can check a labour hire providers licence online.

    From the 29 July 2026 deadline, labour hire providers who aren’t licensed and hosts using unlicensed providers risk severe penalties.

    Report a problem

    Report suspected licensing problems to Consumer and Business Services (CBS) or email occupational@sa.gov.au.
