South Australian laws about using or providing unlicensed labour hire services are changing.
Currently using or providing unlicensed services is against the law for work processing horticulture, meat or seafood, as well as cleaning and trolley collection.
From 29 July 2026 it will be against the law to use or provide unlicensed labour hire services in all industries.
Report licensing issues
You can make a report to Consumer and Business Services (CBS) if you believe someone is:
- operating unlicensed
- avoiding their licensing responsibilities through other arrangements
- failing to provide their licensee and responsible person details to the host.
What you’ll need
Identifying details of the business will help, like a business name, location, ABN, any advertising or licence number.
Report other issues with labour hire providers
Workplace health and safety problems should be reported to SafeWork SA.
Employee rights and conditions problems should be reported to the Fair Work Ombudsman.
Object to an application
Government authorities, agencies, councils and industrial associations can object to an application for a labour hire licence if they don’t think an individual or business director is fit and proper to hold a licence or become the providers responsible person.
Any objection must be made within 14 days of the application notice being published.
