There are a few options available to help resolve a dispute between a park operator and a resident.
- Discuss the problem calmly first:
- If an agreement can't be reached, contact Consumer and Business Services (CBS). They will provide impartial advice and recommend options to resolve the problem.
- Raise the matter with the residents committee
- The park operator must consider matters raised by the committee and provide a written response within one month, or longer if the committee agrees.
- Get help from South Australian Civil and Administrative Tribunal (SACAT)
- If the dispute can't be resolved, either party can request that SACAT determines an outcome.
Park operators breaching the residential park agreement
The resident can take steps to stop the operator's behaviour or end their agreement if the operator breaches the conditions of the agreement.
Breaches could include:
- interfering with a resident's peace, comfort or privacy - eg they don't give correct notice before entering the site
- the property isn't maintained to a reasonable standard
- necessary repairs aren't made after being notified
- trying to change conditions to the agreement without the resident's consent.
Repairs
The resident should put a request to carry out repairs in writing if verbal requests are ignored or refused. A written request should include:
- details of the repairs
- a date they need to be completed by
- the action taken if the repairs aren't completed in time - eg a contractor will carry out the repairs and send an itemised bill to the park operator.
The resident can apply to SACAT who can order the repairs be done if the park operator continues to refuse or ignore the request,
Problems with bond and rent
A park operator can claim all or part of the bond at the end of a rental agreement. The resident can dispute a claim if they believe it's unfair or incorrect.
Request a decision from SACAT
SACAT resolves issues within specific areas of rental law. They could hold conferences, conciliations or mediations and formal hearings.
