Renting in a residential park

    Residential parks could be holiday parks with a mix of short and long term accommodation. They could also be parks that have been designed for long term accommodation, such as a 'lifestyle community' with transportable or constructed homes.

    The resident and the park operator must sign an agreement for a resident to live in the park, who could rent:

    • a site and dwelling
    • just the site.

    Before an agreement is made

    By law, a resident must receive specific information to help them make a decision before they sign an agreement.

    Site and dwelling

    The resident must be given:

    • the park rules
    • details of the park operator and who to contact for emergency repairs
    • information that outlines:
      • rights and responsibilities
      • fees in addition to rent
      • payments the resident could receive when they leave - other than the bond refund.

    Site only

    These documents must  be given to the resident at least 14 days before the agreement is signed:

    The resident can sign an agreement sooner if its both:

    • for a short term - 90 days or less
    • a waiver is signed confirming the tenant has chosen to sign up earlier.

    Tenancy or site agreements

    Agreements can be for a fixed term or a periodic tenancy with no official end date. This applies to both renting a site and site and dwelling.

    Buying or selling a dwelling

    Certain steps must be followed when someone buys a home located in a residential park.

    Buying in a park

    People who want to buy an existing dwelling can ask the park operator for the correct documents. The park operator must provide these within 7 days.

    People can also request newer versions of  the site condition report or disclosure document if they haven't been updated recently,

    Selling in a park

    Moveable homes such as caravans, can be replaced without the park operator’s permission.

    The park operator will need to be notified in writing of any plan to sell a more permanent structure. The park operator can't unreasonably refuse to assign a site agreement to the new owner.

    Death of a resident

    The park operator is given the first option to purchase a dwelling at market value if a resident passes away and the dwelling is to be sold. The person caring for the resident's affairs is responsible for notifying the park owner of the intention to sell. The dwelling can be sold to other people if a purchase agreement with the park operator is not reached within 28  days.
