Terms and conditions - mySAGOV app

These terms and conditions relate to the use of the mySAGOV app, and form a legally binding contract between you and the Crown in right of the State of South Australia.

Access to, and use of, the mySAGOV app is subject to these terms of use. These terms of use may change over time.

By accessing or using the mySAGOV app, you agree to be bound by the terms of use current at that time. The current terms of use are those published on this page at the time of access.  If you do not agree to be bound by these terms of use, you must not use the mySAGOV app.

In these terms of use:

  • 'mySAGOV' means the mySAGOV app, the systems that host the data accessed by the user’s account and the means of access to this data
  • 'personal information’ means information or an opinion, whether true or not, relating to a natural person or the affairs of a natural person whose identity is apparent, or can reasonably be ascertained, from the information or opinion
  • a reference to 'us', 'we', or 'our' is a reference to the Crown in right of the State of South Australia and includes its agents, instrumentalities, officers, and employees from time to time
  • a reference to 'you’ or 'your’ is a reference to you as the end user of the mySAGOV app.

These terms of use are governed by and follow the laws for the time being in force in the State of South Australia, Australia. Any claim relating to use of the mySAGOV app will be heard by the courts of South Australia.

Separate terms of use apply to the mySAGOV account.

Our responsibilities

To the extent permitted by law, we:

  • provide the mySAGOV app and associated systems 'as is’ and without charge
  • give no express or implied warranties or make any representation (and to the full extent permitted by law exclude all statutory warranties) for the mySAGOV app and associated systems (including its availability, security, performance or fitness for a particular purpose)
  • will not be liable for any loss or damage (including special, indirect or consequential) arising from or in connection with the mySAGOV app and associated systems, or their availability, use or performance either directly or through a third-party provider.

To the extent that our liability for the mySAGOV app (or any part of it) cannot be excluded, it is limited to the resupply of the relevant goods or services, or the cost of such resupply, at our option, or otherwise limited to the minimum amount permitted by law.

Your responsibilities

You are responsible for the security and use of your mySAGOV app and the device on which it is stored, including:

  • properly informing yourself of the risks associated with using the internet, applications and online accounts
  • using appropriate and up-to-date operating systems, firewall software and anti-virus software to protect your device.

You must comply with all security requirements and instructions provided by us about your use of the mySAGOV app.

You must:

  • not use the mySAGOV app for any unlawful or improper purpose
  • not disclose your mySAGOV app PIN or account passwords to any other person
  • not circumvent (or attempt to circumvent) any security or authentication measures of the app or any other system, network or server connected to the app
  • provide information that is true, accurate, current and complete when using the mySAGOV app and when you create an account and verify your identity for use with the mySAGOV app
  • always lock your device when not in use
  • not use the mySAGOV app to access someone else’s account or access their credentials or information without their consent
  • notify Service SA if you believe the security of your mySAGOV app or the account used to access it has been compromised, by calling 1300 450 422 (Monday to Friday) during business hours or emailing myaccountassistance@sa.gov.au
  • and take all reasonable measures to limit the impact of any suspected compromise, such as changing your password immediately.

mySAGOV app software

We make the mySAGOV app and software available to you to use, in unaltered form, solely for use in accordance with these terms of use.

All intellectual property including copyright and trademarks in the mySAGOV app and software are either owned by or licensed to us, and nothing in these terms of use vests in you any right of ownership of the intellectual property in the mySAGOV app and software.

Nothing in these terms of use vests in you any right in or to the source code comprised in any software in the mySAGOV app.

You may not:

  • decompile, reverse engineer, disassemble or attempt to derive the source code for the software
  • create derivative works based the software or modify it in any way
  • distribute copies of the software or versions of it.

You must not access the mySAGOV software other than through:

  • the Apple App Store
  • Google Play Store
  • other means approved by us.

We make no guarantee that the mySAGOV app software will function outside supported platforms.

You are responsible for ensuring that the software does not interfere with your systems or devices.

You must ensure your use of the software complies with all applicable conditions of use, including third party software licensing conditions of use, relevant laws, including local laws in any relevant foreign country if you use the software outside Australia. Those laws may impact your eligibility to get or use a copy of the software.

mySAGOV app software uses third party software under licence. A full listing of mySAGOV third party licences and software is available in the app.  You can email us for information about our software at sagovmobileapps@sa.gov.au.

mySAGOV app and associated services

While we will use reasonable efforts to rectify any issues with the mySAGOV app and associated services that we are aware of, and to protect the information that you provide via the mySAGOV app:

  • we make no guarantees that the mySAGOV app, and your access to it, will be continuously available, uninterrupted and fault or error free
  • we make no representations or warranties, express or implied, that the mySAGOV app will be free from, and accept no liability however arising (including liability in negligence) in connection with, any harmful code (including viruses, bugs, Trojan horses, spyware or adware), infection by computer virus or other contamination or third-party interference to your information, data, device or software
  • your access to the mySAGOV app is also contingent on telecommunication services and other factors beyond our control
  • we may suspend or terminate access to the mySAGOV app and associated services through some or all products or to some or all users at any time.

You should take appropriate and adequate precautions to ensure that the information obtained from the mySAGOV app is free of viruses or other contamination that may interfere with or damage your systems, devices or data.

Display and storage of credentials

The mySAGOV app is able to display various credentials such as licences, permits, accreditations, certificates and registrations associated with your account. These are regularly refreshed while your device and the app are connected to the internet. This information is stored on the cache of your device to enable the credentials to be displayed when the device is not connected to the internet. These are deleted once you logout of the mySAGOV app.

You are responsible for all transactions and communications carried out using the digital credentials displayed in the mySAGOV app, and for the security and use of those credentials and the device on which they are stored or accessed.

While the mySAGOV app includes security features to demonstrate the authenticity of credentials, we make no guarantees or assurances that the digital credentials displayed on the mySAGOV app will be accepted as genuine by third parties, including government agencies.

You must:

  • not use your digital credentials for any unlawful or improper purpose other than that which was intended when issued to you
  • not use or otherwise purport to own the digital credentials of others
  • notify Service SA as soon as you suspect or become aware that the security of your mySAGOV app or credentials has been compromised.

Privacy

You acknowledge and agree that we may collect personal information from you using the mySAGOV app.

We will collect, use, store, manage, and may disclose to third parties, your personal information in accordance with the South Australian Information Privacy Principles (IPPs) and as detailed in the mySAGOV app privacy statement.

Breach of terms

Without limiting or derogating from our other rights under these terms of use or at law, if you breach these terms of use in any way, or if we reasonably suspect that you have breached these terms of use, we may:

  • send you one or more formal warnings
  • temporarily suspend your access to the mySAGOV app
  • permanently prohibit you from accessing the mySAGOV app
  • commence legal action against you, whether for breach of contract or otherwise
  • suspend or delete your account on the mySAGOV app.

Where we suspend or prohibit or block your access to the mySAGOV app or a part of the mySAGOV app, you must not take any action to circumvent such suspension or prohibition or blocking.

General

You acknowledge that we may at any time modify, change or refine the features and functionality of the mySAGOV app.

You acknowledge that we may at any time suspend, cancel or revoke your access to the mySAGOV app and associated services.

If you no longer wish to use the mySAGOV app, you may uninstall the app from all devices. If you choose to uninstall mySAGOV app, we will keep and dispose of your personal information in accordance with the State Records Act 1997 or as otherwise required at law.

The mySAGOV application may include links to other applications or websites operated by third parties. These linked applications websites will have their own terms of use and you are responsible for reading and understanding the terms and conditions of use of such third parties.

Any disputes between you and any third-party provider, including another government agency, must be resolved between you and that party.

We are not responsible for any fees charged by other agencies or third-party providers. You are responsible for ensuring the installation and use of the mySAGOV app does not cause you to exceed any data usage quotas or other limitations which may apply to your internet service or other third-party provider.

We:

  • do not sponsor, endorse or necessarily approve of any material on sites linked to or from the mySAGOV app
  • do not authorise the infringement of any intellectual property rights contained in material in linked websites or services
  • do not accept any responsibility for conduct associated with linked sites.

These terms of use constitute the entire agreement between you and us as administrator of the mySAGOV app. They supersede all prior communications, representations, agreements or understanding about these terms.

You will comply with all laws that apply to you in relation to your use of the mySAGOV app.

If any provision of these terms of use are held to be invalid or unenforceable that provision:

  • may be read down to the extent necessary to make it valid and enforceable
  • may be severed and the remaining provisions of the terms of use enforced.

The headings in these terms of use are for reference purposes only and in no way define, limit, construe or describe the scope or extent of any provision of these terms and conditions.
