How to incorporate an association

Incorporated associations have a legal entity separate from their members and usually suit small community-based groups as an alternative to a co-operative or a company limited by guarantee.

Who can apply

Incorporated associations are not-for-profit organisations and don’t engage in trade or commerce unless approved by the Attorney-General. They must benefit the community and usually include areas such as promoting science or the arts, sport and recreation or fundraising for medical treatment.

Before you start

Make sure that your committee members have:

The association’s name

The name should reflect the nature and purpose of the association. The name can’t:

  • the same as a name reserved or registered under the Corporations Act 2001.
  • be easily mistaken for another incorporated association
  • be the same as a registered business or likely mistaken for one.

Reserve a name

You can reserve your association's name if you need extra time to collect the evidence needed for the application.

2. Lodgement

Lodge your reservation and pay the fee of $135.

Apply to incorporate

Complete both sections of the form and sign it in front of a justice of the peace - Incorporation of an association - form 1 and 2 (209 KB PDF)

The name of the association must be the same as shown in the rules.

The official name of the association as shown on the Certificate of Incorporation must be used on all documents and on its common seal. The word ‘Incorporated’ can be abbreviated to Inc.

What happens next

You will receive the Certificate of Incorporation in approximately 14 days.
