Current status

Consultation

This development plan amendment (DPA) is now on public consultation from 17 November 2011 to 25 January 2012.

The amendment instructions are provided in the draft Regulated Trees DPA (PDF 741KB).

The background and overview is explained in the community information sheet (Word 35KB).

Areas affected

The area affected (PDF 161KB) by the DPA is that set by Regulation 6A(2) of the Development Regulations 2008. Generally, this corresponds to Metropolitan Adelaide (as defined by the Development Act) plus selected zones in the Adelaide Hills Council and the District Council of Mount Barker. These are the development plans affected by Regulation 6A of the Development Regulations 2008. Regulation 6A defines the area within which regulated tree controls operate - ie the area within which trees may be 'regulated' or 'significant'.

Need for the amendment

The need for this DPA is brought about by the Development (Regulated Trees) Amendment Act 2009 because this created a new kind of development that is not yet the subject of development plan policy. Tree-damaging activity in relation to a regulated tree is now defined as development by the Development Act 1993.

Purpose of this DPA

The purpose of the DPA is to insert policy regarding regulated trees into relevant development plans in order to enable effective operation of the Development (Regulated Trees) Amendment Act 2009 and the Development (Regulated Trees) Variation Regulations 2011.

Proposed Changes

The DPA proposes to change the affected development plans by inserting policy that provides guidance for the assessment of development applications relating to regulated trees, complementing those policies already in place for significant trees.

Interim operation

The DPA commenced on interim operation on 17 November 2011 for 12 months. This means that the policies being proposed as part of the public consultation will apply 

  • during the consultation period and 
  • for up to 12 months or 
  • until the Minister decides the DPA.

Interim operation is used when the Minister for Planning considers it is necessary in the interests of orderly and proper development.

Consultation process

The Development Policy Advisory Committee (DPAC) conducts public consultation process and provides advice to the Minister on planning and development issues.

Public submissions can be made between 17 November 2011 to 25 January 2012.

Written submissions should clearly indicate whether you wish to be heard at the scheduled public meetings. If no submissions are received or if no-one requests to be heard by the committee the scheduled public meetings may as a result not occur.

Check the Development Policy Advisory Committee before the scheduled date of the meeting to find out whether it is being held.

After the consultation process

The Development Policy Advisory Committee considers the matters raised in submissions and representations at any public meeting and then provides advice for the Minister. The Minister then considers whether to:

  • approve the draft DPA 
  • make amendments to the draft DPA and approve the DPA as amended 
  • decline to approve the DPA.

Alterations following gazettal

Following gazettal, the Environment, Resources and Development Committee of Parliament reviews the approved amendment and may request the Minister to consider alterations. Any subsequent alterations will be notified in the Government Gazette and made to the relevant Development Plans.
