Current status

The Barossa Valley and McLaren Vale Protection Districts development plan amendment (DPA) that was introduced in September 2011 was replaced by the Barossa Valley and McLaren Vale Revised Protection Districts DPA on 29 March 2012.

The DPA was revised in response to submissions received during consultation with the community, councils and other stakeholders from October to December 2011. The revisions addressed concerns about overly restrictive limitations on development in the districts and reflected recent changes to related legislation to protect the character of the districts. 

The revised DPA triggers a new period of public consultation to begin in April 2012. As a result, the public meetings on the 2011 DPA scheduled for 13 March and 20 March 2012 were cancelled.

Anyone who made a submission on the 2011 DPA is invited to make a new submission on the revised DPA.

The 2011 DPA operated on an interim (temporary) basis from 28 September 2011 to 28 March 2012. This means that the proposed policies applied during that period to ensure that inappropriate development did not occur during consultation and consideration of the amendment.

Need for the amendment

The purpose of the 2011 DPA was to reinforce the importance of two unique areas of South Australia – the Barossa Valley and McLaren Vale districts.

The State Government released a package of information in mid 2011 seeking community and stakeholder input into a proposal to establish legislative protection for the districts.

The conclusions of that process were put in draft legislation for consideration by the Parliament of South Australia. 

To reduce the risk of inappropriate development occurring while the new legislation was considered, the DPA provided a mechanism to introduce amendments to the affected development plans to:
  • contain development options in areas outside existing townships, including rural and scenic landscapes and escarpments, being areas where the construction of new buildings and structures will be more obvious and likely to impact views and character values
  • review the forms of development contemplated in township / urban zones to introduce stricter requirements and/or assessment processes for uses with a greater propensity to impact established character, such as larger industrial and commercial buildings.

The DPA supported the intentions of the draft legislation by introducing restrictions on the types of development expected in rural and non-rural areas within the districts, and promoting the retention of heritage values.

Proposed Changes

The affected area includes portions of seven councils in the Barossa Valley and McLaren Vale Protection Districts. The boundaries coincide with the areas that are the subject of related draft legislation and include land within the following council areas:

Barossa Valley District:
  • Adelaide Hills Council (section)
  • The Barossa Council (section)
  • Light Regional Council (section)
  • Mid Murray Council (section)

McLaren Vale District:

  • Adelaide Hills Council (section)
  • City of Burnside (section)
  • City of Mitcham (section)
  • City of Onkaparinga (section)

The DPA proposed to amend zones in the seven council areas that fall within the boundaries of the Barossa Valley or McLaren Vale Districts.

The changes proposed to each Development Plan vary according to the content of the zone affected, and whether the zone is considered to be typically rural or urban in respect to the envisaged land uses.

In broad terms, the DPA focused on amendments needed to the non-complying development list of identified zones to establish greater parity with the objects and objectives of the draft legislation.
