Overview
Any holder of an aquaculture or fishery licence authorising the farming or taking of bivalve molluscs for human consumption must be accredited under the Primary Produce (Food Safety Schemes) (Seafood) Regulations 2006. Bivalve molluscs - or shellfish - include oysters, mussels, scallops, cockles and pipis.
To obtain accreditation a producer must have an approved food safety arrangement. They must:
- only source product from government-classified and monitored waters
- have an approved food safety program
- have the food safety program audited by an approved auditor at the specified frequency
- comply with the relevant sections of the Food Standards Code, including the seafood standard - 4.2.1.

Seafood other than bivalves
Growers and harvesters are considered to be a primary food producer under the Food Act 2001 but this is dependent on the nature of activities undertaken. The legislation and standards section on the PIRSA website gives more information to help determine if a business is a primary food producer or a food business.
A primary food producer is required to produce safe and suitable food (as defined by the Food Act 2001) and conform to the requirements of the Food Standards Code, including the seafood standard - 4.2.1.
PIRSA's Food Safety Program aims to lower the incidence of food-borne illness in the primary industry sectors. This helps to increase consumer and industry confidence and creates market access opportunities for the State's primary industries.
The food safety program ensures growers and harvesters of bivalve molluscs - shellfish - comply with the requirements of the Primary Produce (Food Safety Schemes) (Seafood) Regulations 2006.
